On the marketplace, an offer for the sale of goods is formed by placing a card that reflects information about the product - its name, description, characteristics, price, etc.

However, after the entry into force of the law "On the Platform Economy", the marketplace will allow product cards to be placed only after making sure that certain information is accurate. In this article, we will talk about what the marketplace will check and how the check will be carried out.

How and which product cards will be checked from October 1, 2026

The categories of goods in respect of which the marketplace will conduct information verification and individual special checks are established by Article 7 of the Law "On the Platform Economy". Basically, these include goods that are subject to mandatory labeling, state registration, declaration or certification.

The rules for verifying the information contained in the product card (hereinafter referred to as the Rules) and the procedure for conducting special inspections are established by the Decree of the Government of the Russian Federation dated 02.07.2026 No. 821.

According to these Rules, the marketplace will check, in particular, information about the following products:

  • Pesticides, agrochemicals, biologically active additives (BAAs), medicines and medical devices that are subject to mandatory registration in the relevant registers. The marketplace will not place cards with such goods if it does not make sure that the information specified by the seller (number and date of registration) corresponds to the information contained in the special register and has a valid status;
  • For example, in the list of individual goods marked with means of identification (footwear, perfumes and cosmetics, bedding, toilet and kitchen linen, clothing, etc.). The marketplace will not place a card of such a product if the seller has not registered in the relevant monitoring system and (or) did not indicate the product code contained in the subsystem of the national catalog of labeled goods;
  • Goods that are subject to mandatory confirmation of conformity. In this case, the marketplace will place a product card if it makes sure that the link to the site specified by the seller contains an up-to-date record of certificates (declarations) of conformity for the product.

At the same time, the marketplace will check the need for special checks based on the 10-digit product code submitted by the seller according to the Commodity Nomenclature of Foreign Economic Activity of the EAEU or the 9-digit code according to OKPD 2 (All-Russian Classifier of Products by Types of Economic Activity).

As a general rule, these Rules for verifying the information contained in the product card will apply from October 1, 2026.

How to check the relevance of information

As a general rule, the marketplace will check the relevance of the information contained in the product card at least once every 10 business days, starting from the day the card is placed.

If the relevance of the information is not confirmed, the marketplace will stop placing such a card and notify the seller within one business day, indicating the reasons for terminating the placement of the card.

What will happen to the "old" cards

A transition period has been established for product cards that were published before October 1, 2026. So, according to clause 2 of the Rules, the marketplace will have to check the information posted in the "old" cards within 180 days from the date of entry into force of the Decree of the Government of the Russian Federation dated 02.07.2026 N 821.

Thus, marketplaces must complete the relevant verification no later than March 29, 2027.

How and when the rights to use the trademark will be checked

Separate rules are established to verify information on confirmation of the right to use a trademark. According to the new rules, it will be possible to place a trademark in the product card only after the marketplace makes sure of the legality of its use by checking the data from the State Register of Trademarks and Service Marks of the Russian Federation (hereinafter referred to as the Trademark Register).

For this purpose, the seller, when placing an image (reproduction) of a trademark in the product card, must indicate the following information:

  • the status on the basis of which he uses the trademark – the right holder or the person to whom this right is granted under an agreement with the right holder (licensee);
  • for the right holder - the number of the state registration of the trademark and the date of making an entry on the registration of the mark in the Register of Trademarks;
  • for the licensee - the number of state registration of the granting of the right to use the trademark under the contract and the date of making an entry on the registration of this right in the Trademark Register.

Before allowing a trademark to be placed in the card, the marketplace will check the information specified by the seller for compliance with the information from the Trademark Register. In addition, the marketplace will check the data about the seller, which he provided when concluding an agreement with the marketplace, with the data about the copyright holder or licensee specified in the Trademark Register.

The rules for confirming the right to use a trademark will apply from March 1, 2027.
