“Zuykov and Partners” defended the right to the trademark “Suzuki” in the Intellectual Property Court

Confrontation “Suzuki Motor Corporation” and “Dunham Investments Inc.” and “TechnikaGmbH” has been going on for several years. The conflict was caused by the ownership of trademark “Suzuki”.

Representatives of “Suzuki Motor Corporation” have attempted to cancel the registration of the designation “Suzuki”. However, thanks to the competent and professional representation of the interests of the right holder by the lawyers of “Zuykov and Partners”, the protection of the trademark continues.

Contrary to the opinion of government authorities, “Suzuki Motor Corporation” continues to insist that the registration is illegal. Therefore, the representatives of the company applied to the Intellectual Property Court with a statement to invalidate the decision of Rospatent dated May 16, 2019 and a request to oblige Rospatent to terminate the legal protection of the disputed means of individualization. According to the above act, the specialists of the Patent Office refused to satisfy the objection to the granting of legal protection to the trademark “Suzuki”. Dunham Investments Inc. and TechnikaGmbH were involved in the case as third parties that do not make independent claims regarding the subject of the dispute, “Zuykov and Partners” represent their interests.

During the proceeding, after hearing the positions of the parties and other participants in the case, on September 16, 2020, the Intellectual Property Rights Court decided to dismiss the claim of “Suzuki Motor Corporation”. The decision of Rospatent of May 16, 2019 and the legal protection of the trademark “Suzuki” continued to operate.

Thus, another attempt to cancel the trademark protection of “Zuykov and Partners” clients did not find support from representatives of state authorities.
