The lawyers of the company “Zuykov and Partners” defended the interests of PJSC “Southern Kuzbass” Coal Company”

On April 19, 2019, the Mezhdurechensk City Court of the Kemerovo Region dismissed the claims filed against PJSC “Southern Kuzbass” Coal Company.”

The court received a statement of claim from Krivoshapko A.V. with a claim for the recovery of a sum in the amount of 451,877,920 roubles for the illegal use of a patented invention (patent No. 2604577). The company “Southern Kuzbass” Coal Company” was indicated as a defendant, whose interests were defended by the representatives ofthe company “Zuykov and Partners.”

Having studied the materials of the case and having reviewed the positions of the parties, the court dismissed the claims filed. The position of the judicial instance was motivated by the following:

·         The patent for an invention, to which the plaintiff refers, has been previously declared invalid by Rospatent.

·         By its decision of April 10, 2019 in case No. SIP-359/2018, the Intellectual Property Court upheld the decision of Rospatent.

In connection with the above circumstances, the Mezhdurechensk City Court of the Kemerovo Region made a decision to dismiss the claims of Krivoshapko A.V. on the prohibition of the use of the invention and on the recovery of compensation.
