Russian singer Zara has applied for registration of the Zara trademark for cosmetics and jewelry

Zara LLC, owned by Russian singer Zara (real name Zarifa Mgoyan), has submitted an application to Rospatent for registration of the Zara trademark. The artist already has such a sign, but it belongs to the 41st class of the Nice Classification, i.e. it allows entertainment events to be held under it. The new application, if approved, will give the singer the opportunity to produce cosmetics, clothing, jewelry, watches under this brand. Zara will also be able to produce various food products and produce alcoholic and non-alcoholic beverages.

Lawyers interviewed by Vedomosti believe that it will not be easy for the singer to get approval for the registration of a new application. The obvious obstacle in the 25th class of the Nice classification (clothing) is the rights to the Zara brand from Inditex, says the patent attorney of the company "Online Patent" Victoria Makarova.

Inditex (brands Zara, Bershka, Pull & Bear, Massimo Dutti and Stradivarius) suspended operations in Russia on March 5, 2022. In October, the group agreed to sell the Russian business to its franchisee in Lebanon, Daher Group, and shortly after that, 245 Inditex stores opened outlets under the signs Maag, Ecru, DUB and Vilet, they are not related to Inditex brands.

Sergey Zuykov, Managing Partner of Zuykov and partners, notes that Zara is a very well–known brand, and it is officially recognized as well-known. Therefore, its protection is indefinite and concerns a much wider list of goods and services, he points out. For this reason, Zuykov believes that it will be unrealistic to register a Zara sign without the consent of a Spanish company. At the same time, it cannot be ruled out that Zara is simply trying to protect her name as a brand from possible registration by other companies, Makarova notes.
