Russian associations ask to simplify the removal of counterfeit goods on online platforms

Copyright holders may allow blocking the sale of counterfeit goods through online platforms in a pre-trial manner. Six organizations have asked Prime Minister Mikhail Mishustin to introduce such a rule into the law "On the Platform Economy". In addition, the associations want to introduce mandatory labeling of sellers who have confirmed the rights to the results of intellectual activity. The draft law "On the Platform Economy" is scheduled to be submitted to the government in February 2025. It is expected that the State Duma will adopt it in the spring session.

Now fakes from online platforms are removed manually, but then you have to sue the sellers. The share of fakes in many segments of online commerce reaches 30%, market participants say.

Marketplaces emphasize that they are already taking the necessary measures to combat counterfeiting, so additional regulation is unnecessary.

"The number of goods sold through marketplaces is growing, and sites may not always respond to an increase in counterfeit sales," says Sergey Zuykov, patent attorney and Managing partner at Zuykov and partners. "But, of course, a number of the proposed measures are unnecessary, for example, labeling companies going bankrupt or having tax violations."
