Rospatent Plans to Test a Service for Calculating Average Industry Royalty Rates

In 2026, Rospatent plans to launch a pilot version of a service that will enable users to calculate average royalty rates for the use of IP objects. The information system will be based on data obtained by Rospatent during the state registration of agreements concerning the transfer of exclusive rights to inventions, utility models, industrial designs, and trademarks. The service is expected to allow real-time calculation of average royalty rates for various types of IP across different industries and time periods.

The launch of the “Distributed Register of Rights to Intellectual Property and Means of Individualization in Circulation” is expected to encourage businesses to commercialize their intellectual property. The service will also help public institutions correctly determine the value of IP created with state funding when integrating such assets into economic circulation.

“The creation of this register is a step in the right direction,” said Ildar Shaikhutdinov, a member of the General Council of Delovaya Rossiya (Business Russia). According to him, the current Russian IP market suffers from a lack of transparent valuation benchmarks, leaving companies unsure of the real value of their technologies or patents, while research organizations remain unmotivated to commercialize R&D results.

“When data on royalty rates and payments become available, businesses and universities will have a transparent tool for calculating the commercial value of IP,” noted Kirill Lyakhmanov, head of the IP/IT practice at LCH.LEGAL. However, he added that only about 15% of patents have real commercial potential.

The initiative, according to the expert, will create new conditions for the market as a whole: banks may begin to view IP as collateral, a technology value index may emerge, and corporations will be able to devote more attention to cross-licensing issues.

It is crucial, however, that the data in the register remain anonymized and that no confidential commercial information is disclosed, emphasized Sergey Zuykov, patent attorney and managing partner at Zuykov and partners. He also noted the importance of keeping the service regularly updated with current data; otherwise, its usefulness will be limited.
