Amendments to Kazakhstan’s IP Legislation

The President of Kazakhstan, Kassym-Jomart Tokayev, has signed the Law “On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Intellectual Property Issues.” In particular, changes were made to the Law of the Republic of Kazakhstan dated July 26, 1999, “On Trademarks, Service Marks, Geographical Indications and Appellations of Origin of Goods.”

The law was developed to strengthen the protection of intellectual property rights and provides for the adoption of several measures:

  1. Changes to the timeframes for examinations under the accelerated procedure. Preliminary examination, upon the applicant’s request, will be conducted under an accelerated procedure within 10 working days; under the regular procedure, the review period is 1 month. Full examination, upon the applicant’s request, will be conducted under an accelerated procedure within 3 months from the date of applying; previously, this period was 4 months.
  2. Extension of the deadline for filing objections. The period for filing an objection against the registration of a designation as a trademark has been extended to 2 months from the date of publication of the application.
  3. Introduction of state control over the use of copyright and related rights objects through unscheduled inspections carried out by justice authorities based on applications from authors and rights holders.
  4. Implementation of a unified digital platform in the field of collective rights management.

The amendments will enter into force on January 25, 2026.
