外观专利是指对工业品或手工制作产品的外观所作出的具艺术和设计感的方案。
外观专利通过拟保护对象的照片、电脑渲染图、图纸确定保护范围。保护对象可以是三维的产品形状、二维的平面图案或是两者的结合。
专利法保护产品设计、照片、电脑渲染图、图纸。可授权的客体包括三维的产品形状、二维的平面图案或者是两者的结合。
专利种类
俄罗斯法律规定了三个种类的专利：
- 外观专利
- 发明专利
- 实用新型专利
申请专利的程序和期限
外观专利的注册受严格的法律规限，通常包括以下几个阶段
- 提交申请，2-2.5 周
- 提交申请，2周
- 形审查式，自申请日起的2-3个月
- 实质审查，自形式审查通过日起的8-10个月
- 颁发专利 ，2-3 个月
