The Hague System for the International Registration of Industrial Designs allows an applicant to obtain design protection in up to 97 countries by filing one single international application without the requirement of a basic application.
International design applications are filed with the World Intellectual Property Organization (WIPO). After the administrative procedure by WIPO, the IP Office of each country chosen by an applicant examines the international application independently and then issues a decision regarding the granting of protection.
To apply for international registration under the Hague procedure, there is no need to submit a basic application in Russia separately. It is enough to add it to the list of countries selected for registration.
The Hague System offers a cost-effective solution for obtaining design protection by centralizing all administrative matters. It also provides applicants with a time-saving mechanism for acquiring, maintaining, and managing registered rights on designs.
If the design owner plans to distribute products abroad, it is first important to obtain legal protection of the artistic solution in the selected countries. The owner of the design can send documents to the national patent office of the state in which he plans to register intellectual property or use the international patenting procedure. In the area of design protection operates The Hague System for the International Registration of Industrial Designs. It is beneficial to apply through a country's Patent office if the right holder wants to patent a design in one or two states. In other cases, it is more expedient to use the international system, which will save time and money.
