Zuykov and partners helped Pobeda Factory protect its trademark rights

The IP Court has approved amicable agreements between Pobeda Confectionery Factory LLC and New Technologies LLC in cases concerning the early termination of legal protection of trademarks under certificates No. 572694 “Pobeda” ("Victory") and No. 395927 “Pobeda Vkusa” (“Victory of Taste”) on the grounds of non-use.

In these proceedings, Zuykov and Partners represented the interests of the Pobeda Confectionery Factory.

After verifying the terms of the settlement agreements for compliance with the law, the IP Court concluded that they did not infringe the rights or legitimate interests of third parties and did not contradict legal provisions. Accordingly, the Court approved the agreements and issued rulings to terminate proceedings in cases No. SIP-1311/2024 and SIP-1312/2024.

Under the settlement agreements, the exclusive rights to the disputed trademarks containing the verbal elements “Pobeda” and “Pobeda Vkusa” are transferred to Pobeda Confectionery Factory.

In addition, the opponents agreed to withdraw their trademark registration applications containing the verbal elements “Pobeda” and “Pobeda Vkusa,” and undertook not to file new applications for such designations. In turn, Pobeda Confectionery Factory withdrew its claims in cases No. SIP-1311/2024 and SIP-1312/2024.

Thus, the plaintiff succeeded in securing the exclusive rights to the trademarks “Pobeda” and “Pobeda Vkusa.”
