Zuykov and partners has secured a recovery of 5 million rubles for copyright infringement of the design of the bag "A Secret Knowledge"

The individual entrepreneur E.K. Petrova filed a statement of claim with the Arbitration Court of the City of Moscow against the individual entrepreneur Y.V. Fortuna seeking protection of copyright and recovery of compensation in the amount of 5,000,000 rubles. The subject of the dispute was the unlawful production, public dissemination, offering for sale, and sale by the defendant of transformer bags using the plaintiff’s design through retail outlets and online platforms (website, social networks, marketplaces).

Zuykov and partners in these cases represented the interests of the plaintiff – the individual entrepreneur E.K. Petrova.

Based on the totality of the evidence presented, the court found that the plaintiff is the author and copyright holder of the design of the transforming bag.

In addition, the court established the fact of the defendant's processing of the work of E.K. Petrova and the subsequent distribution of the processed work by offering for sale and selling bags under the brand "JULI FORT", which embody the recycled design of the plaintiff.

The defendant, in turn, did not provide evidence disputing the fact that the plaintiff created the work by creative work and the plaintiff's authorship of the design of the transformer bag, as well as did not provide evidence of the lawful use of the plaintiff's recycled design.

Taking into account the gross and continuing nature of the defendant’s infringement of the plaintiff’s copyright, the court concluded that the plaintiff’s demand for compensation for violation of exclusive rights was justified and should be satisfied in the full amount claimed.

As a result of the case review, the Arbitration Court of the City of Moscow ordered the defendant to remove from its official website and social networks all offers to sell bags embodying the modified design of the plaintiff’s bag, and also ordered the defendant to pay the plaintiff compensation for the unlawful use of the design in the amount of 5,000,000 rubles.

Thus, the lawyers of Zuykov and partners managed to protect the plaintiff's copyright for the design of the transformer bag "A Secret Knowledge".
