«Zuykov & Partners» LLC’ legal experts succeed in cancellation of Grant of Protection of three trademarks “SAAGA” concerning alcohol products
Closed joint-stock company “Istok” which interests were represented by legal experts of “Zuykov & Partners”LLC lodged a lawsuit into Intellectual Property Rights Court on halfway cancellation of Grant of Protection of three trademarks (one of them includes word “SAAGA”, two of them include – “SAAGA 1763”). Right holder of the trademarks is Estonian company “Skanfainest OU”. Plaintiff was interested in cancellation of Grant of Protection concerning goods (alcoholic drinks) on classes 32, 33 of International Classification of Goods and Services.
Closed joint-stock company “Istok” is in the group of companies which produce and realize alcoholic products in the territory of Russian Federation. The plaintiff himself controls quality level of produced goods and controls using of trademarks which belong to the group of companies. Besides, the plaintiff is an applicant for registration of trademark “SAGATM” which registration was refused byRussian Agency for Patents and Trademarks because of the existence of three above mentioned disputed trademarks belonged to the respondent.
Legal experts of our company managed to convince Intellectual Property Rights Court of the plaintiff’s interest in relief demanded in the complaint and cancellation of Grant of protection for the trademarks. Otherwise representatives of the respondent (right holder) were not capable to prove using disputed trademarks concerning goods on classes 32 and 33 of International Classification of goods and services in a three year period before an action was laid as civil legislation demanded.
Intellectual Property Rights Court had analyzed arguments of both parties and recognized that plaintiff’s demands are well-pleaded and must be satisfied. Court cancelled Grant of Protection of disputed trademarks concerning submitted services. In such a way legal experts of “Zuykov & Partners” LLC managed to defend client interests completely and attain riddance of all hurdles for the plaintiff could carry out his activities.
